<p>Mezzanine Loans &#8211; Most of these loans go with a permanent or construction loan, as lenders won&#8217;t exceed 80 percent loan-to-value. 			<content:encoded><![CDATA[<p>In a report released by real estate performance analysts IPD, it has been revealed that commercial property prices have risen for a twentieth consecutive month. A 0.3% increase in March saw the UK values continue on their way up, in what has amounted to a 17% rise since late 2009.</p>
<p>The persistent rise has come after a severe 45% decrease during the economic downturn. The first quarter of 2011 produced 2.3% in total returns in comparison with the 2.2% recorded in the fourth quarter of 2010 according to IPD.</p>
<p>Furthermore, it was announced that retail was the biggest winner, producing total returns of 1% in March. Elsewhere, offices and industrial units produced 0.8% each. However, while incremental increases were being seen for commercial property, all-property rents fell, with office rents dipping for the first time in four months.</p>
<p>This is the first time in over a year that retail property has toppled offices from the top spot.</p>
<p>In another study carried out by CBRE, it was revealed that shopping centres had also improved month-on-month, with a 1.5 % growth in capital values, and total returns of 2%.</p>
<p>However, the data relies heavily on the performance of London&#8217;s commercial property market. Outside the capital, the only other city in the UK to have recorded stable property rents, and a steady increase in commercial property is Aberdeen.</p>
<p>According to data compiled by Knight Frank, commercial property in aberdeen has experienced a marke improvement over the past 2 years, and has exceeded 2009 levels of office take-up. By the end of 2010, 263,162 sq ft of office space had been occupied in the northern city.</p>
<p>In other parts of Scotland the commercial property picture is somewhat skewed, with a slight increase in Edinburgh countered by a regression in Glasgow to Q1 levels of 2010.</p>
<p>Across Scotland towards the end of last year, it seemed that a general increase in office space take-up was on the cards, and with the continued improvement in the UK, it would seem that the property market is making significant strides towards a strong recovery.</p>
<p>One worry however, voiced by Anthea To of Knight Frank, is the overall lack of construction projects, and the potential shortfall in Grade A office space as a result. The limited commercial property will result in an upward pressure on rents due to the increased demand as the recovery takes shape.</p>

<p>As we approach the end of the year, trends of 2010 will continue into 2011, following the same general pattern, with a slow recovery expected towards the end of 2011.</p>
<p>Some speculations predicted that the recovery would have started towards the end of 2010, but with new problems in the international economic markets, it looked like we took a double dip into the current recession. However, economists state that a double dip recession is unlikely, although spending and investments in the established economies have been challenged by emerging economies, like India and China.</p>
<p>Real Estate Trends are following the larger economic picture: the mortgage crisis has indeed caused a lot of turmoil and scars, which have created a domino effect with high unemployment, low consumer spending, consumer credit slow down and weak housing markets.</p>
<p>The large number of homeowners, who have lost their house in foreclosure, are not going to buy another property in the near future, because of the impact of the foreclosure on their credit (banks will not even consider a mortgage for a borrower for 4 years, if he/she had a foreclosure, 3 years for FHA loans,) therefore there is a new population of renters.</p>

			<content:encoded><![CDATA[<p>No one would invest in a piece of commercial real estate without investigating it&#8217;s resale value, income generating potential, building structure, etc. However, there are a couple of things that seem to get overlooked, even by the savviest investors. Following are the four most overlooked items that you should consider when you are selling or buying a commercial property:</p>
<p>Has the building been unoccupied for more than 180 days?</p>
<p>Collier County has an established Land Development Code (LDC) that governs things like a building&#8217;s architectural standards, setbacks, landscape and parking requirements. These requirements vary based on the district where the property is located. The LDC is reviewed and updated twice a year and new projects are required to comply with the codes. Existing buildings are usually &#8220;grandfathered&#8221; in, however, there are certain times that a building is subject to review for compliance with the current land development code.</p>
<p>One reason a building is subject to review is if it is unoccupied for a period of more than 180 consecutive days. To bring newer buildings into compliance with the LDC may be as simple as revamping the landscaping with extra trees or buffer shrubs. However, with older buildings it can be very costly. A local businessman purchased an older building with the intention of using it as a warehouse-showroom. When he tried to get a permit for a renovation, he was informed that he would have to change the front facade of the building to include among other things, a 75% glass storefront. To bring this building into compliance, it would have meant serious structural changes that increased the renovation costs by tens of thousands of dollars. The project proved infeasible and the building was subsequently resold and developed.</p>
<p>Will the occupational license require a change of use for the building?</p>
<p>Another reason that would make the building subject to review for compliance with the land development code would be if there was a &#8220;change of use.&#8221; Change of use doesn&#8217;t necessarily mean a zoning change. It can mean going from a jewelry store to an office supply store, or a retail store to a restaurant. The reason for this review is to make certain that the new use is in compliance with the permitted uses of the specific zoning area. This review also ensures that there is adequate infrastructure (ie parking) to support the new use.</p>
<p>Will the building need alterations to the fire alarm or sprinkler system?</p>
<p>Another overlooked item is the fire safety system, which includes the fire alarm and fire sprinklers. By adding sprinklers or changing out a fire panel, you open the whole fire safety system up for review and it will have to be brought up to current code. Depending on the age of the building, this can include relocating the fire alarms on the wall; adding fire sprinkler heads; or replacing an entire control panel, which can add thousands of dollars to a project. If you are in doubt, get a consultation with a qualified general contractor or architect during your due diligence period.</p>
<p>Have you allotted enough TIME for planning and permitting?</p>
<p>Permitting is frequently the place where owners don&#8217;t allot enough time. According to the City of Naples Building Division, it typically takes three-four weeks for a permit application to be reviewed and a permit issued. However, if your permit application is rejected it can take another two-four weeks after your plans have been revised by the architect. According to the Collier County Building Department, it typically takes six weeks for a permit application to be reviewed and permitted. Depending on the complexity of the project and allowing for a couple of rejections, it is more realistic to plan on three to twelve months for a permit to be issued. A renovation might be three months and a building under 10,000sft might take six-nine months. Unfortunately, there are NO short cuts in getting through the permitting process.</p>
<p>With proper planning, your commercial real estate transaction can go smoothly and provide you with a profitable investment. If you have any questions about the process, it would be wise to consult with a reputable commercial general contractor and an architect.</p>

<p>Do you have a restaurant space that you would like to fill with a quality tenant? Certainly there is no lack of tenants out there that would be interested in your site, so how do you go about finding the right tenant? This information was created specifically for Landlords who want to find the right tenant for their property.</p>
<p>When a prospective tenant is looking for a restaurant space, you as the prospective Landlord should know what they&#8217;re looking for, and in this order its; a lease they can afford, a site that fits their concept design wise, visible signage space, and parking. Everything beyond this is secondary.</p>
<p>Yes, the quality of the location is of vital importance, but the affordability of the site is paramount. Armed with this information, you should be able to present a sales package to your prospective tenant in terms that they can understand. If you can make the location financially easy to get into, that will give your prospective tenant the extra cash to commit to the other things related to getting the new restaurant off the ground.</p>
<p>In order to protect yourself from an unqualified tenant, there are many questions that you will want answers to. Set your expectations with the prospective tenant upon your first initial meeting. By doing this and listening closely to the answers, you can avoid a lot of potential pain for both of you.</p>
<p>Six factors that can help you select the right tenant:</p>
<p>#1. Create an interview checklist. You will want to cover a lot of ground with your new prospective tenant, and you&#8217;ll want to ask relevant questions. Depending on your unique situation, you may have legal restrictions placed on your ability to ask questions, so you will want to review your interview game plan with your legal advisor. This information is meant to be informative only and is not to be considered legal or accounting advice.</p>
<p>#2. Credit worthiness. Let the prospective tenant know that you care about their prompt payment history, and that you will expect them to personally be on the lease. Few restaurateurs will want to personally sign a lease, and it will be important to deal with this matter right up front. If the prospective tenant knows that their personal creditworthiness is of importance to you, you&#8217;ll cut right to the chase every time. Are you as a Landlord willing to lease to a company with little or no operating history? Perhaps if you have a space that has been vacant for a while you&#8217;d consider it, but you will want a significant amount of financial security up front.</p>
<p>#3. Background check. There&#8217;s an old saying that goes something like this, &#8220;What has happened in the past is indicative of what may happen in the future&#8221;. Your prospective tenant may have a background that may not be spotless. Only you can be the judge of what you are willing to tolerate-but don&#8217;t forget that old saying. Background checks are inexpensive and can provide a lot of valuable information into the business dealings of your prospective tenant.</p>
<p>#4. Feasibility study. Has your prospective tenant had a feasibility study done or is one planned? This study will evaluate the chances of success of the new restaurant venture, by examining the location and facilities offered (such as: walk in coolers, delivery doors, restroom facilities, and power availability), concept, competition, niche market, financial opportunity, and the overall viability of the project. This study will give you and your tenant the security in knowing that the new restaurant may be the right concept in the right area. If the prospective tenant has not considered a study, and you like what you see from the Landlord perspective so far, you may wish to split the cost of a feasibility study with the tenant, or just pay for it yourself and bill the prospective tenant back over time. The findings are hard hitting, and factors that never may have been contemplated may be brought to light. Most importantly, the Feasibility Study will help identify and confirm the market niche that your prospective tenant is seeking to fill. This is of vital importance both to you and to your prospective tenant.</p>
<p>#5. Business plan. A restaurant business plan is focused on the menu, and everything revolves around it, including revenues, expenses, equipment, payroll projections and all of the other numbers and concepts that will go into a business plan. It is not realistic to think that your prospective tenant has a business plan yet, because the location issue is still unresolved, as it the seating count, and so many other variables. Want to surprise a quality prospective tenant with something great? Offer them a long term lease that includes a business plan that you are willing to pay for (and of course, include in the lease terms). This will set you apart as a caring Landlord who wants the very best for the tenant. Don&#8217;t you think this would be just the thing to close the deal? Think about how few Landlords are including a business plan with an executed lease, and you could end up being the Landlord of choice! One of the nice hidden factors in this equation is that as you have commissioned the business plan as the Landlord; don&#8217;t you now have the ability to give your input into the concept as a whole? Now, you are not only the Landlord, you have become somewhat of an informal business partner, allowing you a good view of what&#8217;s happening in your space without being surprised.</p>

Long-term capital gains are generally taxed at a rate lower than your personal income tax rate. That is a bonus and another reason to leave your 9 to 5 job and start a career in real estate. The IRS considers long-term investments as those lasting over a period of one year. Short-term capital gains are taxed at your normal income tax rate, which could be as high as 35 percent for some taxpayers.</p>
<p>Although the capital gains rate and holding periods seem to fluctuate with changing administrations, the recent tendency has been to keep the rate below your ordinary income tax rate. Before May 6, 2003, the rates were 20 percent for most long-term gains and 10 percent for taxpayers in the 15 percent category. Currently, the long-term capital gains rate is 15 percent for most taxpayers. If you fall into the 10 or 15 percent tax brackets, the capital gains rate is only 5 percent. The incentive is simple. Hold on to real estate longer than a year before selling to reduce your tax liability. For foreclosures and properties that you were planning to resell, it will be necessary to rent out the property for at least one year before selling. Capital gains occur when you buy a property and sell it for more than what you paid for it or the basis of the property. The basis can be affected by expenses, but for simplicity if you bought a property for $50,000 and sold it a few years later for $65,000, then you have incurred a capital gain of $15,000 and it will be taxed at 15 percent. So, you owe Uncle Sam $2,250.</p>
<p>That&#8217;s pretty easy so far. Now, how about depreciation? If you depreciate a rental house, then there will come a day of reckoning. In essence, the government has loaned you money and now it&#8217;s time to pay back your debt. Depreciation recovery is taxed at your tax rate, or 25 percent in most cases. In our previous example, you may have depreciated the property for a few years. Let&#8217;s say the depreciation taken is $5,000. This $5,000 is recovered and taxed at 25 percent. To summarize, you bought an investment property at $50,000 and sold it for $65,000. You depreciated the property so that its new basis is now $45,000. You owe taxes on $20,000, but at two different rates as shown below: Investment Property Example Purchase Price = $50,000 Purchase Price Sale Price Tax Rate Taxes Due Appreciation = $15,000 15% $2,250 Original Basis = Depreciation = $5,000 25% $1,250 $50,000 New Basis = $45,000 Not Applicable $0 Total $3,500 So are there any ways around paying these taxes?
